European Union Withdrawal Rights and Returns Policy

Special Edition Products and Subscription Orders

Many products offered by Midnight Whispers, Roses & Thorns, and Pheonix brands are exclusive editions manufactured specifically for our company and subscriber community. These products may include exclusive covers, custom artwork, sprayed or digitally printed edges, foil embellishments, custom endpapers, signed editions, tip-ins, and other limited-edition features.

By placing an order, customers acknowledge that inventory is purchased, allocated, reserved, and in many cases manufactured specifically to fulfill subscriber and customer demand. Production planning, inventory procurement, and order allocation begin shortly after payment is processed.

Once production, procurement, or inventory allocation has commenced, orders may not be canceled except where required by applicable law.

European Union Consumer Withdrawal Rights

If you reside in the European Union, you may have a statutory right to withdraw from certain purchases within fourteen (14) days of receiving your order, subject to any applicable exemptions under law.

Where an exemption applies, including but not limited to products that are personalized, custom-manufactured, made to order, or otherwise exempt under applicable consumer protection laws, the right of withdrawal may not be available.

Nothing in this policy is intended to limit any mandatory consumer rights provided under applicable law.

Exercising Your Right of Withdrawal

To exercise a valid right of withdrawal, you must notify us in writing within fourteen (14) days of receiving your order. Return instructions will be provided upon approval of your request.

Return Conditions

For returns made pursuant to applicable withdrawal rights:

  • Customers are responsible for all return shipping costs.
  • Customers are responsible for any customs duties, import taxes, brokerage fees, or other charges associated with the return shipment.
  • Returned items must be sent back in their original packaging and condition.
  • Customers are responsible for ensuring returned items are adequately packaged to prevent damage during transit.
  • The customer bears the risk of loss or damage until the returned item is received by us.

Reduction of Refunds for Diminished Value

Refunds may be reduced to reflect any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Examples may include, but are not limited to:

  • Damaged or torn packaging
  • Scratches, dents, bends, or other physical damage
  • Missing inserts, merchandise, or included items
  • Damage caused by improper storage, handling, or return packaging

Any reduction will be assessed based on the condition of the returned goods upon receipt.

Shipping Charges

Original shipping charges, customs fees, duties, taxes, insurance costs, and other non-product charges are non-refundable except where required by applicable law.

Refused Deliveries

Customers who refuse delivery of an order remain responsible for any shipping charges, return shipping charges, customs fees, duties, taxes, carrier fees, storage fees, or other costs incurred as a result of the refusal. To the extent permitted by law, such amounts may be deducted from any refund issued.

Damaged or Defective Items

Customers who receive damaged, defective, or incorrect items must contact us within fourteen (14) days of delivery and provide photographic evidence. Upon review, we may provide a replacement, store credit, partial refund, or full refund, at our discretion and in accordance with applicable law.
